NEW YORK – Tom Brady might have reason to practice more intensely after a federal judge made clear Wednesday that the NFL's four-game suspension of the New England Patriots quarterback over "Deflategate" is in jeopardy.

Looking suspiciously like golden boy plays. Was there ever ANY doubt?

Good. I want him to play. No excuses. Get the 2014 Superbowl banner BS over with, let's roll the ball out and let's play.

The judge is doing nothing but scaring these guys into a settlement. He also told the NFLPA that he might not be able to make his decision by the 4th.

This report is complete crap. Berman did not make anything "clear." These reporters are taking Berman's line of questioning and running with it.

Meanwhile, there are other reports that Brady is willing to accept a one-game penalty for lack of cooperation; why would he do this if it is 'clear' that Berman will rule in his favor? Perhaps, as other reports have stated, Berman is going to allow witnesses to testify; and this may be what Brady is wanting to avoid.

Brady is guilty as hell. And the only reason he may get away with it is because the NFL doesn't has subpoena power. So Brady is hiding behind a "you have no evidence" argument in a case in which the employer wasn't allowed to properly gather it. DUH!

If the players are going to be allowed to hide behind such legal protections, then the NFL is going to have to be allowed full subpoena and act like a police state. Is that what the NFLPA wants?

Those reports of Brady maybe willing etc... Happened before the rest of the gamut today, but I agree I'm sure the spin is misleading as usual.

Brady will play. And it's off old Rog's plate. He put up a nice front, got it into the courts and now the decision is out of his hands so now he will be back in the good graces of his BFF. Nice job Rog! People with half a brain know you did this to call off the dogs who constantly bash you. You failed. The worst commissioner ever in Professional sports.

It will be a shoot out between Ben and the deflator. Bring it!

where was the evidence in bens case? this is a hornets nest in waiting. the cba gives goodell sole power in these cases and now a judge can rule he doesn' have that authority? that goes against the cba then. how many of these former players can now go back and file in court that they're suspensions were unjust also? this judge would nullify the whole cba by making any change in it. this is a huge case that could bring alot of change with it. brady accepting a game suspension goes against the 5th ammendment also of self incrimination. bringing up a whole nother question in this mess. here's what i would do. since the patriots organization is responsible for they're team and the deflation of the footballs, don't take it out on just tom tom, make the whole team forfeit the first four games and not one player alone would be responsible but the team as a whole.

Exactly why this is a huge precedent and problem if they rule in favour of Brady. Crazy ... Bell may have a chance for reduction as will many other players. In a sense teh CBA means nothing if the judge is able to overturn.

Brady will receive a suspension, how many games he will miss is the only question left to resolve, if no agreement is met between the NFLPA and the League Judge Berman will rule on how many games Brady will be suspended , most likely the judge will hand down a 2 game suspension to split the difference between the two litigants.......

My gut tells me that it will not be resolved for a long time. Berman will render a judgment, which will then be appealed. Pending appeal, the NFLPA will obtain an injunction that stays the suspension pending the final outcome. If brady actually serves a suspension, I expect it to be in the 2016 or 2017 season. Anything can happen, but that's where I see this mess going.

I see a couple problems with this line of thought.

    1) Thats a lot to happen in 3 weeks time before the start of the season. Judge has said he may not even make a ruling by Sept 4th.

    2) Would be risky and stupid of NE to allow that as they, Brady and players union have no say over a judges docket. He'll hear the case according to his schedule which very well may happen this season putting Brady at risk of missing playoff games should he lose.

I still think it will end up at 2 games effective immediately.

yeah, its clear Schefter and the other talking heads are riding Bradys jock and don't want to see him punished.

I'll take that much more enjoyment from it should his suspension hold.

I would think that judge would have to take in and account for the nature of the NFL and consider that golden boy could have a major injury at any point and be knocked out of the game for an undetermined period of time.

Then any penalty other than the beginning of this season is possibly nullified in the chance it could be career ending.

    Its not hypothetical at all.

He'll end up with nothing less than the first 2 games.

    You're right.

The hearing on Wednesday is now leading the Brady camp to dig in again. So in essence, the judge, who wanted this matter settled, just hurt the chances of that with his line of questioning.

I wouldn't be overly surprised if the judge rules that it's 2 games, but I would then expect the NFLPA to seek a stay while they appeal to a higher court. In my work, I deal with federal court appeals on a regular basis, and the wheels of justice turn pretty slowly. If it goes to a higher court, it may take quite a while to even get to the evidentiary portion of the docket - possibly not even until after the season. They'd almost have to grant a stay of the suspension because not granting a stay would result in application of the very punishment being appealed. The NFL and NFLPA got a favorable break from Berman with respect to him taking the case up quickly. I'd be surprised if the appellate court moved with that same degree of urgency. Unless there's a settlement, I think he plays not only week 1, but the entire season. That's my prediction, and I'm sticking to it.

Now, rumor has it that Brady is willing to take a 1 game suspension for not cooperating, and not admit guilt. If that's true, the NFL may want to consider it. They stand to lose a lot of disciplinary authority if this case ultimately goes against them.

Again, thats a huge gamble to take and I don't see it moving that slowly.

I also doubt Brady and NFLPA will appeal if it's reduced to 2 games, only if it remains at 4 games.

    We shall see.

Meanwhile, this all goes on costing the government way too much money over someone who's already making millions and ratified the CBA to have the powers he's challenging.....

32 team owners want this issue settled by Sept 4, when has 32 billionaires never got what they wanted? The ruling will be a 2 game suspension to commence the first 2 games of the season, so that both sides will feel they had a victory....
