Because all of the evidence that was used in the decision is now a matter of record. On appeal, you can't introduce new evidence. Brady and the NFLPA have to argue the punishment was unjust based on the evidence the NFL actually had in its possession at the time.

Good thing for Brady. If you read Goodell's document that TTF posted a link to in another thread, he basically inferred that destruction of the cell phone could have upped the suspension to 6 games (the same as using a PED and attempting to cover it up with a masking agent).

I thought there was a good chance that Brady would play week 1, but this cell phone deal is fatal. He will be out all 4 Games IMO.

There is a better chance the Ravens will benefit from not facing brady

I honestly would say that most celebrities do destroy their cell phones a lot. However, in this case it seems VERY convenient. Somebody told me today that Brady said he destroyed it because it had pics of Gisele. Is that actually true? I've just got home and haven't been able to read anything about it.

So will Brady pursue a court hearing or is this the end of it?

I guess that is the only way he plays week 1, if he prolongs the suspension somehow?

Like I said before, it is better for ratings and advertising if he plays, so I can see some secret agreement being made that he plays the first game or two and is suspended down the road.

I'm not even sure how things like this go to court, NFL and NFPA agreement kind of resides outside the realm of normal business/employee relatioships. The players agree to the process of suspensions, if they don't like it they need o renegotiate when it comes up.

considering they told him that they only wanted text messages and emails pertaining to the case and made sure to take extra steps to insure that his privacy in non football related stuff. Either way I question this supposedly smart QB's intelligence in having pictures of his wife on his phone. Hackers love that stuff.

The courts should deny any appeal by anyone unless a players constitutional rights are violated by the NFL. Are the courts going to regulate NFL disciplinary actions from now on?

I do not see it. The courts will not hear his appeal.

Yeah if he was really doing that that is incredibly reckless. I mean I think that's a really stupid thing to do when you're NOT famous but it's even more dumb when you are.

I agree that this is not a constitutional issue. Unless he plans to say they "slandered" him or something. I think even if he does "clear his name" he will still be suspended.

I had not heard that it was new evidence, I thought it was just coming to light now for the public but that it weighed in on Goodels decision to suspend him originally.

Regardless, I don't think they win even without that piece of information.

I hope Brady does get an injunction, plays week 1 and loses the appeal during the course of the season and then serves his suspension during the playoffs. That would be awesome.

No way he wins the appeal. I think he's a complete idiot for fighting it, he's going to miss games when they are more vital.

I'd rather he play than the back-up. One of two things happen.

    1. He plays with chip on his shoulder and lights the Defense up. (would require some re-assessment of the defense)

    2. He plays and this Defense is able to contain him. (Shows they can handle a pretty good QB right out of the gate)

Problem with the back-up playing is you don't know how they'll play with him so game planning would be generic. Also, probably some crap Belichek pulled from the back of the rulebook and no one else has seen yet.

We have kind of a lousy record of playing down to teams we should beat or teams missing star players. Therefore seeing Jimmy G. in week 1 worries me.

I will make no apologies: I want Brady out. Why? because Bell is out. Furthermore...

A win is a win. It's a 16-game schedule, and the difference between a 1-seed and a wild card can be razor thin. Given that I don't expect the D to jell right out of the gate, a Brady-led Pats team would thump the Steelers. If the game were being played later in the season, then bring it on. But for the Steelers to have a shot at that #1 seed, they'll need to win this game, and trying to do so, in week 1, at Foxborough, without Belll...uh, not gonna happen.

How sweet would it be if this backfires horribly and he ends up getting an even larger punishment? I can dream.

I don't care what anyone says about this. The Bottom line was that the Balls were set within the league rules, and after that Patriot Employee took the bag, and then went into a Bathroom with the Balls where Cameras do not excist...then those balls are all deflated ?...except for 2 of them that the Kicker uses is all the evidence I ever needed. No WAY does a Lowly Patriots employee deflate any of those balls without Brady/Belicheck telling him to do so.

    Guilty

Only problem with that is, the NFL beat them to the court house: Scott Soshnick of Bloomberg reports that the NFL has filed a pre-emptive lawsuit in federal court in Manhattan, seeking affirmation of the outcome of the Brady appeal.
